The most common kind of software piracy occurs when a programmer surreptitiously peddles innovative software directly to a large marketer. This can be countered by proper investigation and possibly litigation. The development process should be probed to see if software's usual evolutionary track is followed. The suspect competitor's source code, design documents, software and manuals should be compared. Possible legal theories on which to base litigation include trade secret, copyright and patent. Expert evidence may be necessary.
