From the supplier: Plaintiffs' attorneys in products liability suits in which the defendant is filing for bankruptcy must take certain steps to preserve clients' claims. Timely filing of a proof of claim is the most important. The debtor then has the burden to file an objection, which must be served on the plaintiff. The automatic stay which goes into effect with a bankruptcy filing applies only to the debtor, not any other defendants in the suit, and can be modified if the debtor holds liability insurance covering the product claim. Creditor approval of a reorganization plan and payment procedures are covered.
